1. Acceptance of Terms

By using the services provided by BrightCarry Aliso Viejo Towing, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use our services. We reserve the right to update or modify these terms at any time without prior notice.

2. Service Description

BrightCarry Aliso Viejo Towing provides towing and roadside assistance services including but not limited to emergency towing, flatbed towing, long-distance towing, roadside assistance, battery jump-starts, tire changes, lockout services, accident recovery, winching, motorcycle towing, junk car removal, and heavy-duty towing. All services are subject to availability and geographic limitations.

3. Payment Terms

Payment is due at the time services are rendered unless other arrangements have been made in advance. We accept cash, credit cards, and debit cards. Prices are quoted based on the information you provide and may be adjusted if the actual situation differs from what was described. Additional fees may apply for services performed outside normal business hours, in hazardous conditions, or requiring specialized equipment.

4. Vehicle Owner Responsibility

You represent that you are the legal owner of the vehicle or have authorization from the owner to request towing services. You are responsible for removing all personal belongings from your vehicle before it is towed. BrightCarry Aliso Viejo Towing is not responsible for items left in vehicles during transport or storage.

5. Liability and Insurance

BrightCarry Aliso Viejo Towing carries insurance as required by state and local law. We take reasonable care to protect your vehicle during towing and transport. However, we are not liable for pre-existing damage, mechanical failures, or damage caused by conditions beyond our control. Our liability is limited to the actual cash value of your vehicle or the cost of repairs, whichever is less. We are not responsible for consequential or indirect damages including loss of use, lost wages, or rental car expenses.

6. Storage and Impound

If your vehicle is stored at our facility, daily storage fees will apply after the first 24 hours. You must retrieve your vehicle during our posted business hours and provide valid identification and proof of ownership. Vehicles not claimed within the time period specified by law may be subject to lien sale proceedings.

7. Cancellations

If you need to cancel a service request, please notify us as soon as possible. Cancellation fees may apply if our truck has already been dispatched or is en route to your location. We reserve the right to charge a service call fee for cancellations made after our operator has arrived at the scene.

8. Disputes and Legal Issues

Any disputes arising from these terms or our services will be resolved through binding arbitration in Orange County, California. You agree to waive your right to a jury trial and to participate in class action lawsuits. These terms are governed by the laws of the State of California.
